TruckingBazaar User Agreement
This User Agreement ("Agreement") is a contract between you and TruckingBazaar ("TruckingBazaar", "we", "us") and governs your use of the TruckingBazaar website, apps and services (the "Platform"). By creating an account, checking the agreement box or using the Platform, you agree to this Agreement. If you do not agree, do not use the Platform.
1. Who may use TruckingBazaar
- You must be at least 18 years old and able to enter into a binding contract.
- If you sign up for a company, you confirm that you are authorized to accept this Agreement on that company's behalf. "You" then means both you and the company.
- You are responsible for holding any licenses, operating authority, registrations (for example USDOT/MC numbers), insurance and permits that your trucking business legally requires.
2. Your account and the accounts you create
- Keep your login details private. You are responsible for all activity under your account.
- A company account can create dispatch company, dispatch member and driver accounts. You are responsible for the people you invite, the information you enter about them, and what they do on the Platform.
- Give accurate, current information and keep it up to date. Tell us right away if you think your account has been accessed without permission.
3. What you can do on TruckingBazaar
Allowed:
- Manage your own fleet: trucks, trailers, drivers, dispatch teams and their documents.
- Send loads to your drivers, track trips, locations, PTI inspections, fuel, expenses and driver reports.
- Message the people in your own company, and post, like and comment on the public feed respectfully.
- Use the free public tools (such as scan-to-PDF and convert-to-Excel) for your own lawful business documents.
- Export or download your own company's data and documents.
4. What you must not do
Not allowed:
- Enter false, misleading or someone else's information, or impersonate another person or company.
- Upload forged, altered or expired documents and present them as valid (licenses, insurance, registrations, permits, inspections, bills of lading, etc.).
- Upload another person's personal documents (passport, green card, license, TWIC, etc.) without that person's knowledge and permission.
- Use the Platform to arrange illegal freight, or in any way that breaks transportation, safety, hours-of-service, labor, tax, export or other laws.
- Pressure or require drivers to use the Platform in an unsafe way, for example while the vehicle is moving.
- Harass, threaten, discriminate against or spam anyone, or post illegal, hateful, sexual, violent or misleading content.
- Try to view, change or delete another company's data, test or break the Platform's security, or access accounts that are not yours.
- Copy, scrape, resell or sublicense the Platform, use bots or automated access, or reverse-engineer its software.
- Upload viruses or other harmful code, or overload the Platform.
- Share or sell your account, or create accounts for people who have not agreed to use the Platform.
5. Your data and documents
- You keep ownership of the data, documents, photos and posts you upload ("Your Content").
- You give TruckingBazaar permission to store, process, display and back up Your Content only as needed to run the Platform for you. Content you post to the public feed can be seen by other users and visitors.
- Your company's operating data is visible only to your own company accounts (company, dispatch companies, dispatch members and drivers you created), unless you choose to share it.
- You are responsible for having the right to upload Your Content, including your drivers' consent for their personal documents and location tracking.
- TruckingBazaar does not verify that uploaded documents are genuine, valid or current. Expiry reminders are a convenience only.
6. Location and driver tracking
- Driver location is collected only while a driver is using the Platform and has allowed location access on their device.
- You must tell your drivers that their location and trip activity can be seen by their company and dispatch team, and you must follow the privacy and employment laws that apply to you.
7. TruckingBazaar is a software tool
- TruckingBazaar provides software. We are not a motor carrier, freight broker, freight forwarder, employer of drivers, or a party to any load, rate or contract between users.
- You remain fully responsible for safety, compliance, dispatch decisions, payments and everything that happens on the road.
8. Plans and fees
- Companies that sign up become Gold Members. Access is currently free of charge.
- If we introduce paid plans or limits, we will tell you in advance, and you can decide whether to continue before any charge applies.
9. Suspension and closing your account
- You can stop using the Platform and ask us to close your account at any time.
- We may suspend or close accounts that break this Agreement, put other users at risk or expose us to legal liability. Where reasonable, we will tell you first.
10. Disclaimers and limitation of liability
- The Platform is provided "as is" and "as available". We work to keep it running and secure, but we do not guarantee it will be uninterrupted, error-free or that data will never be lost. Keep your own copies of important documents.
- To the fullest extent the law allows, TruckingBazaar is not liable for indirect, incidental or consequential damages, lost profits, lost loads, fines or penalties, or for the acts of other users.
- You agree to cover TruckingBazaar's losses that come from your breach of this Agreement or your misuse of the Platform.
11. Changes to this Agreement
We may update this Agreement from time to time. We will change the "Last updated" date and, for important changes, notify you on the Platform or by email. If you continue to use the Platform after a change takes effect, you accept the updated Agreement.
12. Governing law
This Agreement is governed by the laws of the United States and of the state in which TruckingBazaar is registered, without regard to conflict-of-law rules.
